I have a dentist friend name Tom.  Tom is a county employee, a civil servant practicing dentistry for Suffolk County, NY.  He is divorced and has been paying alimony to his ex-wife for many years.  The divorce decree requires that his alimony payments increase in direct proportion to any increase in his earned income.  He hates his ex with a passion and hasn't seen her face or heard her voice for many years.  Tom recently refused to accept a promotion to Department Director because it came with a very large salary increase.  What?  Yes, he refused the promotion and big salary increase.  His real reason for rejecting the promotion is that his ex-wife would also benefit from his good fortune.  Tom can't stand the idea of her having a share in his "windfall."

Legal Judgments

A legal judgment (spelled judgment, not judgement) is a money (monetary) financial award decreed (ordered) by a judge as part of the verdict in a lawsuit or other civil court case.  The final judgment does not provide for collection of the money owed but authorizes the "winner" to use legal means to enforce and collect the award from the debtor.

Domesticate, domestication, domesticating

The terms "domesticate and domestication" refer to the legal process by which a lawful civil judgment becomes recognized as lawful by a state other than the one that issued the judgment.  Such a process is needed whenever the debtor resides and has assets in a state or states other than the one where the court decree or court order was made.  The root of the word domesticate means domicile; your domicile is your home.  The judgment must be "at home" in the states of the debtor and his assets.

Uncollected Judgments, Unsatisfied, Uncollected, Unpaid Judgments

Between 80-85% of all legal judgments remain uncollected after 5 or more years.
Those legal judgments that are collected are typically done by experienced professionals working within the legal systems of the various states in the USA.  Enforcing and collecting a lawful court judgment is not easy work.  It requires a great deal of training, knowledge, skill and perseverance.  Many companies and training programs in this field purport to be experts, but are really nothing more than charlatans, cheats, thieves who are only experts at taking your money and disappearing.

Enforcement.  Enforcing and Recovery of Legal Judgments

Judgment enforcement, using lawful means, is authorized by the courts that order the judgments.

Enforcing a judgment includes locating the debtor, locating the debtor's assets in most forms, with a few exceptions that are protected by law.  Available assets usually include the income earned by the debtor, savings and other bank accounts, investment accounts, real estate, automobiles, trucks, jewelry, contents of safe deposit boxes in banks, and much more.

Collecting Money Judgments

Why Not Use An Attorney ?

Attorneys typically require an advance retainer and bill you by the hour for their time.  They collect whether or not they suceed in collecting the judgment for you.  Lawyers do not generally have the training, skills or experience needed to get the job done correctly.  It is common for attorneys and other legal professionals to use our professional services as regards issues of judgment recovery, finding hidden assets, judgment domestications and more.  Attorneys are ideal for initiating or defending lawsuits, but not quite appropriate as enforcers and collectors of legal judgments.

Debtor Going Bankrupt ?

Bankruptcy is a legally declared inability or impairment of ability of an individual or organizations to pay their creditors.  A debtor, as a strategy to avoid paying any legal debt, including a lawful court judgment, may threaten to declare bankruptcy OR actually file for bankruptcy.  Filing for bankruptcy provides the debtor with temporary protection from creditors.  This gets even more interesting when creditors take action to block this action from being effecitve.

Locating Debtor Assets

It is obvious that you can't legally attach (seize, appropriate) assets of a debtor unless you have the authority of a court order by means of the legal judgment that resulted from the lawsuit that you won, and you must also know the WHAT and WHERE of his assets.  What are his assets and where are they located.
